The Controls of Asbestos Regulations 2006 states that the person or organisation responsible for the maintenance or repair of non-domestic premises is classed as the dutyholder and as such is responsible for the asbestos that may be contained within.

If asbestos is present, the dutyholder has a duty to manage it. To effectively manage, the dutyholder must establish where the asbestos is located, how much of it there is and its overall condition. With this information, the risk of asbestos fibre release can be assessed and then a plan to manage this risk implemented.
